AGREEMENT
1. I agree that as a Victorian Memories Independent Consultant, I am an independent contractor, and not an employee, agent, partner, legal consultant, or franchisee of Victorian Memories. I understand that I shall not be treated as an employee of Victorian Memories for Federal and State Tax purposes.
2. I understand that I have the right to terminate this Agreement at any time with or without reason. I understand that such termination must be in writing. I understand and agree that Victorian Memories may terminate this Agreement at any time, with or without reason, upon written notice to me. Victorian Memories also reserves the right to terminate the contract of any Consultant who misrepresents Victorian Memories company or products.
3. I am at least 18 years old and of majority age and my performing under this contract will not alter my responsibility under any other contract.
4. Consultant agrees to pay Victorian Memories for all ordered merchandise in advance of delivery. Consultant agrees that the trade names, trademarks, copyrights and logos of Victorian Memories are the property of Victorian Memories and agrees not to use the trade names, trademarks, copyrights or logos in any type of advertising or promotional materials in any medium, including the internet without the prior written permission of Victorian Memories. Consultant shall not own or operate a web site or advertise on any web site other than a web site approved, authorized or sponsored by Victorian Memories for promoting their products.
5. Consultant is authorized by Victorian Memories and agrees to make only those product claims that are specifically set out for each product in printed materials supplied by Victorian Memories to Consultant.
6. Consultant shall assume full responsibility for collecting any taxes on goods sold that are taxable and consultant shall receive 40% commission of the retail price of products.
7. This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas.
8. Consultant understands that she/he is an independent Contractor and is responsible for all state, federal and local taxes and regulations and laws.
